1. Agreement to these terms
These Terms of Service ("Terms") govern your use of the SchoolsOut mobile app (the "App") and this website. By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.
2. Who can use SchoolsOut
SchoolsOut is made for students of all ages. If you're under the age of majority where you live, please make sure a parent or guardian has reviewed these Terms with you and agrees to them on your behalf.
3. Your license to use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your own non-commercial use, subject to these Terms and the Apple Media Services Terms and Conditions.
4. Acceptable use
You agree not to:
- copy, modify, sell, or redistribute the App or any part of it;
- reverse engineer, decompile, or try to extract the App's source code, except where the law allows it;
- remove or change any copyright, trademark or other notices in the App;
- use the App in any way that breaks the law or infringes anyone else's rights.
5. Your content
Everything you add to SchoolsOut — classes, assignments, tests, events, breaks and preferences — belongs to you. It's stored only on your device, and we don't access it. You're responsible for backing up your device; if you delete the App or lose your device, your SchoolsOut data may be lost and we can't recover it.
6. Our intellectual property
The App, including its design, code, the SchoolsOut name and logo, the acorn artwork and the Scout character, is owned by us and protected by copyright, trademark and other laws. These Terms don't give you any rights to use them except as part of using the App.
7. Reminders & accuracy
SchoolsOut shows countdowns and schedules based on the information you enter and your device's clock. We work hard to make it reliable, but we can't guarantee it will always be accurate or available. Your school, teachers and official timetables are always the final word — please don't rely on SchoolsOut as your only record of deadlines, exams or other important dates. Acorns and progress are just for fun and have no monetary value.
8. Apple App Store terms
If you downloaded the App from Apple's App Store, you also acknowledge that:
- these Terms are between you and us, not Apple, and Apple isn't responsible for the App or its content;
- Apple has no obligation to provide maintenance or support for the App;
- if the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the App;
- Apple isn't responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, or consumer protection claims;
- Apple isn't responsible for investigating, defending, settling or discharging any third-party claim that the App infringes that third party's intellectual property rights;
- you are not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We don't promise that the App will be error-free, uninterrupted, or that it will meet every need you have.
10. Limitation of liability
To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, missed deadlines, grades or opportunities, arising from your use of (or inability to use) the App. Our total liability for any claim relating to the App is limited to the amount you paid for it, if anything. Some places don't allow these limitations, so some of them may not apply to you.
11. Termination
You can stop using SchoolsOut at any time by deleting it from your device. We may suspend or end your license to use the App if you break these Terms. Sections that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will continue to apply.
12. Changes to the App & terms
We may update, change or stop offering parts of the App at any time. We may also update these Terms; when we do, we'll change the "Last updated" date above. If you keep using the App after changes take effect, you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which the developer of SchoolsOut resides, without regard to conflict-of-law rules. Nothing in these Terms takes away rights you have under the consumer protection laws of the country where you live.
